Yeah, I don't see that as being an issue.
Nothing says loosing their ability to sell in any/all states (each state issues a Sales/Use Tax Certificate/Permit, even those states that have zero Sales/Use Taxes) more than trying to break the law.
Lose the ability to sell in a state, lose the ability to sell in all states. No faster way to kill a corporation than that.
Edit: I mean, I get it. You have the ill-gotten mindset that all businesses/corporations are corrupt, but what you perceive and what is reality are two very different things.
The goal is make money, if in the future scalpers.LLC is willing to buy 100% of stock at cost and resell saving the company one whole dollar bill, it's going to happen.
Company loses all liability, no more warranty, no more insurance, no more customer service. All the problems fall on the middlemen scalper.LLC So, what's the difference between a scalper and a retailer in your example?
Because they bought only 1 type of product?
Besides, manufacturers have contracts with wholesale distributors (who are either subsidiaries or outright suppliers to "big box" chains like Best Buy, Walmart, etc.) for at least X amount of products, who in turn distributes those products to various outlets (aka Y number of products to Z number of stores).
No manufacturer will ever solely distribute to one company. It is plain bad business sense to do so. Why sell to one person when 50 people are wanting to buy your stuff?
Edit: Like I said before, your perceived biases do not conform to reality. You can try to think of any "loopholes" you want, but reality will be vastly different than your biases.

The great thing about scalpers (for the company) is not only do they buy all the stock out on day 1 but it induces a massive feeling of FOMO among consumers and so they are going to impulse buy crap out of fear of missing out.
Is it illegal for the companies themselves to employ agents to buy their own products and resell them on Ebay? xD Not only would it allow them to resell the products far higher prices but creates more demand.
There is no downside for them.
Also found it amusing people were outraged by the PS5 scalpers, without working out who was causing it. The direct cause of the scalpers for consoles were Streamers and Youtubers, who were buying them at massively inflated prices and creating the demand in the first place.

I'm 99.9% sure that it is also illegal in most other civilized nation.

GPU companies already got caught selling direct to scalpers this year and nothing happened.
WoTC/hasbro already started cutting the LGS and distribution centers for a % of the MTG stock and sell direct on Amazon.
Times are changing. Nvidia did not sell directly to scalpers. Scalpers bought the products from store shelves (or online shelves in some cases) and turned around to directly sell through Ebay.
As for WoTC/Hasbro selling directly to Amazon, again, not illegal to do so. Amazon is still considered a retailer, and WoTC has the option to sell their products through Amazon (as a retailer) who has the most access to customers than most distribution centers (aka brick/mortar stores that only sell to a smaller portion of the population).
It is not like either company is directly selling their products themselves.

Varying definitions of what constitutes a retailer- and confusion bred in a system designed mostly 90 years ago without the slightest clue how to quantify modern retail.
If I buy from a manufacturer's website, it sure can look and feel like one is buying "direct". In reality, they likely have a subsidiary of themselves in the retail division, or you get sent to a very innocuous 3rd party site that in all ways feels like where you came from while "shopping".
Or hearing the term "brick and mortar", yet seeing Amazon as the largest retailer and the majority of people's only exposure to them is online and their delivery trucks.
But the biggest reason is that as with all tech growth, the demands of the market grow faster than the environment in which they operate. One aspect I'd imagine all of us can agree on is that trying to regulate a digital marketplace that ignores state and national borders doesn't work with the current legislation on the books. Some needs to go, new ones need written.

I would imagine all states have some sort of laws on their books about online retailers by now.

Watched that yesterday, cringed a bit when he said he didn't like it and wanted a reboot because "you had to have a wiki open to play it".
I get what he is saying but a lot of the reason FFXI is so good is because it doesn't hold your hand with everything, it's confusing for a reason. The reason was originally for you to ask other people and for you to reach out to the community.

The reason was originally for you to ask other people and for you to reach out to the community. My real life "friends" who simultaneously try to get me to play XIV with them and insult XI with every breath (despite never having played it) shared this video in our group conversation recently, along with heavy implications that XI didn't deserve the effort to remake it and that they ought to just let the bleeding wound die.
I can't escape it anywhere. And all these little irritations are really starting to culminate.
