1. If you swap over and have the bits you go and use the anatomically correct bathroom. And by anatomically correct, you use what you can according to what you're left with post-op.
2. As to the HIV/ AIDS quesion... If you have either condition it's a crime of some sort in any places. Really depending on the jurisdiction you're looking could be misdemeanor to a felony. Depends on how sexual contact was initiated (consensual vs. rape) and the outcome (did you infect your partner/victim). Even in places where it's not a criminal offense, your partner/victim can sue you civilly. Nothing fancy there, could use assault as the cause of action in a law suit. Hell even throw in some intentional infliction of emotional distress.
