Looks like the Justice Department is finally dropping the Flynn case at the recommendation of Jeff Jensen, the U.S. attorney overseeing the case.
Among the e-mails and notes he was given was one from a senior FBI official that said, “What’s our goal? Truth/admission or to get him to lie, so we can prosecute him or get him fired?” Yeah, Flynn lied all on his own well before he even spoke to the FBI. No one forced him to lie to the Vice President. He got fired by two Presidents for being a scumbag. He was guilty. He was never gonna get jailtime anyways, he should have walked away with the deal 2 years ago. Oh well.
It’s just one of those situations where if he really is a guilty scumbag, then maybe it would have been better to play it by the book instead of resorting to scumbag tactics just to entrap him. It would be nice to have at least one group in Washington that isn’t corrupt.

The crime was lying to the FBI, which used questionable tactics to make that happen in the first place. Whether or not Flynn is a lying scumbag in general is irrelevant, because otherwise we wouldn’t have any politicians left. It's not a crime, HOWEVER, it's certainly a firable offense. I'm seeing Fox News running with the Flynn is a victim story for 2 years now about how this case cost him his career, his savings, his reputation, and it's a bunch of ***. The only person responsible for ruining Mike Flynn's life is Mike Flynn. He got fired by two Presidents, and we are supposed to believe someone else ruined his career? Nah.
Fair enough. I just view lying in general as status quo Washington (unfortunately).
It should be noted that the Judge of the case has yet to actually dismiss the charges. That's notable because the same judge has issued quite a few withering rebukes to Flynn's legal argument that he was a victim of FBI entrapment, even pointing out that Flynn lied to the VP on his own.
The Judge was already leery of Flynn withdrawing his guilty plea, so that's definitely something to keep an eye on. Just because the Trump DOJ wants to drop the charges, doesn't mean it will happen. Senior Democrat officials at the FBI, CIA and DoJ can only break the rules so much if they don't have cover from the Oval Office. Should President Trump win another term, which looks to be the case, I foresee a bunch of retirements from those Senior Democrats being submitted early next year. Here's the thing, FBI agents don't just go off half cocked like that, they wouldn't of done such a brazenly unethical thing without approval from Comey and Senior DoJ officials first. So here's the thing, if they were this open and unethical with Flynn, what did they do to the rest that we don't know about? /yawn.

I would imagine the judge will want to hear an explanation before agreeing to dismiss the case. Flynn's guilt was beyond doubt. I would also expect the IG to investigate the decision making that went into dropping the case.
I’m sure that IG will be asked to resign shortly.
Honestly all the questions the IG could ask can be asked by the Judge. Given Barr's bogus explanation today, he better work on those answers.
It’s ok Trump is already accusing the DoJ under Obama of treason. Clearly the man doesn’t see the irony or the impact of such an argument of his own assertion of total immunity.

There had to be a legitimate investigative purpose for the interview. If the primary purpose of the interview was to set up a perjury trap instead of obtaining evidence pertaining to the investigation (which unsealed documents show was a clear possibility) then the perjury is inadmissible. I suppose it's similar to how evidence obtained by illegal searches is inadmissible.
Either way, it's a huge gray area that actual lawyers and judges will have to work out instead of armchair internet lawyers. This never would have happened if the investigators (and yes, Flynn too) had some actual integrity, though. |
