I have asked several people and got back completely different answers every time. How does the eva cap work? From combining all the nonsence this is what im guessing. Say the skill cap is 350 the eva gear cap is say 30 above that so if my skill was capped and I wore +40 worth of gear I would only benefit from +30 of it? Is this close and does anyone know the proper numbers? Thanks again.

Eva rate is just the inverse of hitrate, once the mob's hitrate is down to 20% you can't increase your evasion further. The actual value differs from mob to mob though.
No, they too are floored at 20%
I don't know whether they do or not, unless you're just about hitting eva cap it shouldn't matter.

Hit rate is based on the level difference between you and the mob, and your evasion VS. it's accuracy. The minimum hit rate is 20%. No matter how much evasion you stack, even a level 1 mob will hit you 20% of the time.

So if you are capped on skill does the gear help at all?
If enemy hitrate is not 20%, yes.
